Please read these Terms of Service ('Terms', 'Terms of Service') carefully before using the services offered by Top Yacht Premier Charters ('us', 'we', or 'our'). Your access to and use of the Service is conditioned upon your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who wish to access or use the Service. By booking a charter, you signify your acceptance of these Terms.
1. Charter Agreement
All charters are subject to a separate Charter Agreement, which will be provided upon booking. The Charter Agreement, along with these Terms, constitutes the entire agreement between the client (the 'Charterer') and Top Yacht Premier Charters. In case of any conflict between these Terms and the Charter Agreement, the Charter Agreement shall prevail. The Charter Agreement must be signed and returned before the charter can commence.
2. Booking and Payment
2.1. Reservation: A booking is considered confirmed only upon receipt of a signed Charter Agreement and the required deposit payment.
2.2. Deposit: A deposit of 50% of the total charter fee is required to confirm your booking. The remaining 50% is due 30 days prior to the charter start date.
2.3. Short Notice Bookings: For bookings made within 30 days of the charter date, the full charter fee is due upon signing the Charter Agreement.
2.4. Payment Methods: Payments can be made via bank transfer or credit card. Credit card payments may be subject to a processing fee.
3. Cancellation Policy
3.1. Cancellation by Charterer:
- Cancellations made more than 60 days before the charter: Full refund of deposit, less a 10% administrative fee.
- Cancellations made between 30 and 60 days before the charter: The 50% deposit is forfeited.
- Cancellations made within 30 days of the charter: 100% of the charter fee is forfeited.
We strongly recommend the Charterer obtains comprehensive travel and cancellation insurance.
3.2. Cancellation by Us: We reserve the right to cancel a charter due to unforeseen circumstances, such as mechanical failure, or safety concerns. In such an event, we will make every effort to provide a suitable replacement yacht. If no replacement is available, the Charterer will receive a full refund of all payments made. This shall be the full extent of our liability.
4. Client Responsibility and Conduct
The Charterer is responsible for the conduct of all members of their party. We expect all guests to behave in a respectful manner towards the crew, the vessel, and other individuals. The captain has the ultimate authority to terminate a charter at any time if the behavior of the Charterer or their guests is deemed unsafe, illegal, disruptive, or in violation of local laws and customs, without any refund. The use of any illegal substances is strictly forbidden and will result in the immediate termination of the charter.
5. Damage to the Vessel and Equipment
The Charterer and their guests are financially responsible for any and all damages they cause to the yacht, its equipment, or any third-party property during the charter period. This includes damages caused by negligence, recklessness, or willful misconduct. The cost of repair or replacement will be billed to the Charterer. A security deposit may be required as outlined in the Charter Agreement. This deposit will be held against any potential damages and will be returned, less any deductions, after the post-charter inspection.
6. Lost or Stolen Property
Top Yacht Premier Charters, its employees, and its agents are not responsible for any personal belongings that are lost, stolen, or damaged during the charter. Guests are solely responsible for their personal items. We advise against bringing valuables on board. Any items left behind will be held for a short period (14 days), after which they will be disposed of at our discretion.
7. Safety and Authority of the Captain
The safety of the vessel and all persons on board is paramount. The Captain has absolute authority in all matters concerning the safety and operation of the yacht and its itinerary. The Captain's decisions are final. The Charterer and their guests agree to comply with all safety briefings and instructions from the crew.
8. Limitation of Liability
To the fullest extent permitted by law, Top Yacht Premier Charters shall not be liable for any injury, death, loss, or damage to persons or property arising from any cause whatsoever during the charter. All activities, including but not limited to swimming, use of water toys, and boarding or disembarking the vessel, are undertaken at the guests' own risk.
9. Governing Law and Jurisdiction
These Terms and the Charter Agreement shall be governed and construed in accordance with the laws of the United Arab Emirates as applied in the Emirate of Dubai. Any dispute arising out of or in connection with these terms, including any question regarding its existence, validity, or termination, shall be referred to and finally resolved by the Dubai Courts.
10. Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide notice of any material changes by posting the new Terms on this page and updating the 'Last updated' date. Your continued use of our services after any such changes constitutes your acceptance of the new Terms.
